NOTICE OF INFORMATION MEETING TO BE HELD:

WEDNESDAY, JUNE 6, 2012
7:00 pm at SISLER HIGH
1360 REDWOOD AVENUE
Twin Lakes Beach Association is providing an opportunity for its members and other guests around Lake Manitoba to hear a presentation by Dave Kochan, a lawyer with Edmonds and Associates. He will analyze the merits of a case to take action against the Province for the flooding of Lake Manitoba properties. Questions from the floor will follow.

The Twin Lakes Beach Association provides the evening free of charge and in the spirit of collegiality for those who choose to attend from other areas around Lake Manitoba.  The Association does not take a position on the issues under review but believes that information is critical in making these important decisions.

The following questions may help you decide whether or not to attend by suggesting outcomes expected by the planners.

1.      WHY ARE WE SUING AND WHAT IS THE EXPECTED GAIN THAT A CLAIMANT MIGHT REASONABLY EXPECT IF OUR SUIT IS SUCCESSFUL?
2.      WHAT IS A CLASS ACTION SUIT?
3.      HOW MANY CLAIMANTS DO YOU NEED TO HAVE A CLASS ACTION?  IS IT BETTER TO HAVE ONE LARGE GROUP OR SEPARATE GROUPS LAUNCHING ACTION FROM INDIVIDUAL DEVELOPMENT AREAS AROUND THE LAKE?
4.      HOW LONG DOES A CLASS ACTION SUIT GENERALLY TAKE TO SETTLE?
5.      HOW MUCH DOES IT COST TO INITIALLY FILE A STATEMENT OF CLAIM?
6.      HOW WILL THE LEGAL FEES BE DETERMINED AND PAID OUT TO THE INDIVIDUALS IN THE SUIT?
7.      WHAT WILL THE FEES BE IF WE LOSE?
8.      DO PROPERTY OWNERS AT TWIN LAKES BEACH (OR OTHER FLOOD- AFFECTED DEVELOPMENTS AROUND THE LAKE MANITOBA BASIN) HAVE A LEGITIMATE CLAIM AGAINST THE PROVINCE AND WHAT WOULD THAT CLAIM BE?
9.      CAN I BE PART OF A SUIT AND STILL CONTINUE TO NEGOTIATE WITH THE RON BELL APPEAL COMMISSION AT THE SAME TIME?
10.  CAN I CHANGE MY MIND AND DROP OUT OF THE CLASS ACTION SUIT AT ANY TIME?   HOW WILL MY COSTS OF BEING IN THE CLASS ACTION BE DETERMINED AT THE TIME OF MY WITHDRAWL FROM THE CLASS ACTION?
11.  SINCE EACH CLAIMANT IN THE SUIT HAS SUFFERED A DIFFERENT DEGREE OF DAMAGES, HOW WILL THE AWARD OR SETTLEMENT REACHED BE DIVIDED AMONGST THE CLAIMANTS?
12.  IF AT THE END OF TONIGHT’S MEETING I HAVE AN INTEREST TO BE A PARTY OF THIS ACTION, HOW DO I SIGN UP OR IF I STILL WANT TO TAKE SOME TIME TO DECIDE IF I WANT TO JOIN OR NOT, HOW MUCH TIME DO I HAVE?  IS THERE GOING TO BE A SPECIFIC DEADLINE AS TO WHEN INDIVIDUALS MUST ENTER THIS STATEMENT OF CLAIM?
